Photography Contract: Full Session

This document is a contractual agreement made between Jody Foster Photography (referred to hereafter as 'Photographer') and; Client Name(s) (referred to hereafter as 'Client(s)'):

Photographer hereby agrees to perform photo services for the above-mentioned client. The Services shall be performed on the date/time of at the following location: ____________________________________________

The photographer and client agree to the following conditions:

Session Fees

The Client agrees to pay a session fee of $_________ to reserve the above listed date and time and covers the photographers time, digital photos and including any assistants.
A 50% retainer of the full session fee must be made at the time of booking to hold the session date and time and must be paid 14 days prior to the session (or upon booking if less than 14 days). This retainer is non-refundable and is credited towards your full session fee.
The remaining balance of the full session fee must be paid no later than 24 hours prior to the session date and time and is non-refundable except in extenuating circumstances.
Fees cover the photo session, initial edits and proofs, final edits and full access to downloading final photos from an online gallery.
Additional editing, retouching or creative editing of images is available at an extra cost per photo to be determined by the photographer based on the specific request.
Photographer retains the right to edit the photographs as she sees fit based on experience and expertise and omit any image(s) that do not meet her standards.

Venues and Travel Costs

Client will be responsible for any and all fees for the use of private venues or location costs.
Client agrees to pay a travel rate of $0.59 per kilometer (as per Canada Revenue Agency’s per-kilometer allowance) for locations beyond 50 kilometers from the photographer’s address.

Cancellations / Postponements

The client understands that by entering into this agreement, the photographer is foregoing other paid clients.
In the event of a cancellation or postponement of the photo session/agreement by the Client, 50% retainer fees are non-refundable.
Rescheduling for just cause will be allowed on a case by case basis with 48 hours notice prior to the agreed to photo session date and time, and when this occurs, retainers paid shall be credited towards the new date.
If it is not possible for a session to take place on a scheduled day due to weather, Photographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge.
Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.
In the unlikely event the photographer is unable to perform the photo session on the agreed date and time, the photographer shall refund all monies paid to the client and shall have no further requirement with respect to the contract unless both parties agree to re-schedule all or part of the session to a new date within a reasonable timeframe.

Cooperation / No-shows

Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions, or for missed images due to details not revealed to Photographer.
Photographer’s camera is the only camera allowed at the photo session because of the distraction it causes, especially to small children, which hinders the Photographer’s ability to obtain quality shots.
If Client and/or key individuals fail to appear to a scheduled photo session, the 50% retainer is non-refundable.
If the Client and/or key individuals arrive late to the session, only the remaining time left in the session will be available to the client(s) and no refunds will be made, in whole or in part.
The session can be rescheduled at the original portrait session fee, including an additional 25% retainer above the original retainer fee already paid for no-shows.

Re-shoots

In the unlikely event that the Client is completely dissatisfied with the final results, Photographer will re-shoot the session at no additional charge one time if the dissatisfaction arises from technical image quality issues.
Re-shoots or refunds WILL NOT be offered for poor choices in clothing, make-up, hair, weather-related and behavioral issues or events that are beyond Photographer's control. Clothing, hair or make-up is a personal choice, and the client may retain their own stylist or make-up artist on location at the client’s cost to ensure they are satisfied with their appearance prior to and during the photo session.

Proofs of Images / Downloading Final Photos

Clients will receive access to a private online gallery to choose your final photos. These will be available for high-resolution download.
If the client requests the final photos be placed on a USB stick, an additional charge of $15.00 will be required.
Client shall review proofs online within 7 days of notification from the photographer.
Photographer retains the right to edit photos and omit any images prior to providing images for proofing.
Client will have 30 days, from date of notification by the photographer, to download all final images from their personal online gallery. After this time, the photos will be removed by the photographer and not be archived.

Copyright / Photo Use

NOTICE OF COPYRIGHT: All images are copyrighted to and remain the property of Jody Foster Photography. It is ILLEGAL to copy, alter or reproduce these photographs outside of the agreed to uses in this contract without the written permission of the photographer.
Photos may be printed, physically or digitally shared with friends or family or shared on social media platforms / websites for personal and business use.
Altering photos is strictly prohibited, including any further edits not completed by the photographer such as extracting parts of images, modifying color or cropping.
Client authorizes the photographer the use of all images created under this agreement and unrestricted right to use and publish photographs of Client, client’s child or children, or pets for the use of advertising and other business purposes.

Summary

This contract contains the entire understanding between the photographer and client(s). It supersedes all prior agreements between the parties.
Changes or additions to this contract can only be done in writing, signed by all parties.
The Client agrees that he/she is responsible for all parties involved with the agreed upon photo session.
If there is an individual involved in the photo session who does not agree to the terms of this agreement the Client assumes responsibility for any liability.
